Depakote Restitution Fund Announcement

The Minnesota Attorney General’s Office obtained $1.7 million in settlement funds from a multi-state action against Abbott Laboratories, a drug company, for marketing the drug Depakote for uses that have not been approved by the FDA.

Depakote was FDA-approved to treat seizure disorders, mania associated with bipolar disorder, and prophylaxis of migraines, but was marketed to treat other conditions, such as treatment for depression, anxiety, obsessive-compulsive disorder, post-traumatic stress disorder, alcohol and drug withdrawal, attention deficit disorder, and autism, among other conditions.

Many states, including Minnesota, sued Abbott Laboratories for this off-label marketing of Depakote, and obtained money from Abbott Laboratories through a settlement, which may be distributed as restitution. 

The Attorney General’s Office is now reaching out to physicians and hospitals to help identify patients who used Depakote for conditions not approved by the FDA.  Those patients may be eligible for payment from the restitution fund.
