Wins new nationwide injunction blocking unconstitutional EO on birthright citizenship; wins back $74M for Minnesota schools that Trump Administration had illegally frozen

July 25, 2025 (SAINT PAUL) — Minnesota Attorney General Ellison notched two wins late today that will further protect Minnesotans against illegal and unconstitutional actions by the Trump Administration. The federal district court in Massachusetts issued a new nationwide preliminary injunction that once again blocks President Trump’s unconstitutional birthright citizenship executive order from taking effect. Attorney General Ellison and a coalition of state attorneys general first sued to block Trump’s executive order on birthright citizenship on January 21.

Further, the Trump Administration today agreed to fully release $74 million in promised funding for Minnesota schools that it suddenly froze on July 1. On July 14, Attorney General Ellison and a similar coalition sued the administration over this illegal nationwide funding freeze to six critical school-funding programs worth more than $6 billion to schools nationwide. The litigation is ongoing.

“I am very pleased that the court has once again blocked on a nationwide basis President Trump’s unconstitutional attempt to end birthright citizenship,” Attorney General Ellison said. “This action is both in keeping with the recent Supreme Court ruling on nationwide injunctions and underscores the vital importance of states standing up to the President when he acts unlawfully, since it was states’ involvement that allowed for a nationwide injunction. We will continue to litigate this case and I remain confident we will succeed in stopping President Trump from violating the Constitution and stripping citizenship from people born in the United States.

“I am very disappointed that it took multiple lawsuits and bipartisan pushback to convince the Trump Administration to release the crucial education funding they had illegally frozen,” Attorney General Ellison continued. “These are our tax dollars, and Minnesotans have a right to expect them to be used to support our students and our schools. Given that the Administration’s promises are typically worth little, I will continue to monitor the situation closely to ensure the Administration keeps its word and will not hesitate to take them back to court if that’s what it takes to get Minnesota’s money back.”
